Terms of Service
Effective September 19, 2026 · version 2026-09-19
These Terms of Service ("Terms") are a binding agreement between you and AW Structural Services, LLC ("Company," "we," "us") governing your access to and use of Wind Load Calculator and the website at aw-structural.com (together, the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to the Professional Use and Engineering Disclaimer, which is incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You represent that you are a licensed professional engineer, or are acting under the responsible charge of one, that you are at least 18 years old, and that you have authority to bind any entity on whose behalf you use the Service.
2. Account and Seats
You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity under your account. Subscriptions are licensed per the seat count you purchase. You may not share credentials across more users than your plan permits.
3. License Grant
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal professional purposes during your paid subscription term.
4. Restrictions
You will not, and will not permit others to: (a) reverse engineer, decompile, or attempt to derive the source code or underlying calculation logic of the Service; (b) resell, sublicense, rent, or provide the Service to third parties as a service bureau; (c) copy, scrape, or create derivative works; (d) circumvent usage, seat, or security limits; or (e) use the Service unlawfully or outside its documented scope.
5. Subscriptions, Fees, Billing, and Cancellation
5.1 Plans. The Service is offered on a subscription basis under a monthly plan and an annual plan. The fees, billing interval, and any free-trial terms applicable to your plan are presented at signup.
5.2 Free trial. A free trial of 30 days is available so you may evaluate the Service before being charged. If you do not cancel before the trial ends, your paid subscription begins and the applicable fee is charged.
5.3 Fees and taxes. All fees are stated exclusive of taxes, and you are responsible for any applicable taxes.
5.4 Automatic renewal. Subscriptions renew automatically for successive periods of the same length unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for each renewal at the then-current rate. For annual subscriptions, we will send a renewal reminder to your account email in advance of the renewal charge.
5.5 Cancellation. You may cancel at any time from your account or by emailing us at ahmad@aw-structural.com. Cancellation stops future renewals. Your access continues through the end of the period you have already paid for, and you are not charged again after that period ends.
5.6 No refunds. Except where a refund is required by applicable law, all fees are non-refundable. Cancelling does not entitle you to a refund of fees already paid, including for any unused portion of a current monthly or annual term. You retain access for the remainder of the paid term as described in Section 5.5.
6. Intellectual Property
The Service, including all software, calculation logic, interfaces, and content, is owned by the Company and protected by intellectual property laws. These Terms grant you a license to use the Service, not ownership of it. The outputs you generate from your own inputs are yours to use within these Terms.
7. Disclaimer and Warranties
The Service is provided "as is" and "as available." The warranty disclaimers in the Professional Use and Engineering Disclaimer apply in full and are incorporated here.
8. Limitation of Liability
The limitation of liability in the Professional Use and Engineering Disclaimer applies to these Terms and to the entire Service, and is incorporated here in full.
9. Indemnification
The indemnification obligation in the Professional Use and Engineering Disclaimer applies to these Terms and is incorporated here in full.
10. Term and Termination
These Terms apply while you use the Service. You may cancel at any time, effective at the end of your current billing period. We may suspend or terminate your access for breach of these Terms, non-payment, or misuse. Sections concerning the Disclaimer, intellectual property, limitation of liability, indemnification, and governing law survive termination.
11. Changes to the Service and Terms
We may modify the Service and these Terms. Material changes to the Terms will be posted with an updated effective date, and continued use after the change constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. The state and federal courts located in Ohio will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
13. Miscellaneous
If any provision is unenforceable, the rest remains in effect (severability). These Terms, with the Disclaimer and Privacy Policy, are the entire agreement. You may not assign these Terms; we may assign them in connection with a sale of the business. The Company is not liable for delays or failures caused by events beyond its reasonable control (force majeure). Notices to the Company may be sent to ahmad@aw-structural.com.
Professional Use & Engineering Disclaimer
Effective September 19, 2026 · version 2026-09-19
This Professional Use and Engineering Disclaimer ("Disclaimer") governs your use of Wind Load Calculator (the "Software"), a software application provided by AW Structural Services, LLC ("Company," "we," "us"). This Disclaimer is incorporated into and forms part of our Terms of Service. By accessing or using the Software, you accept this Disclaimer.
1. Nature of the Software
The Software is a computational aid that performs wind load calculations referencing provisions of ASCE/SEI 7-22, Chapters 26 through 32. The Software performs arithmetic and applies formulas to inputs you supply. It is not a substitute for engineering judgment, and it does not perform engineering services. Use of the Software does not create an engineer-client relationship between you and the Company, and the Company is not, and does not act as, the engineer of record for any project.
2. You Are Responsible for the Results
By using the Software, you represent and agree that:
(a) You are a licensed professional engineer, or you are working under the direct supervision and responsible charge of a licensed professional engineer, and you are competent to evaluate the Software's outputs.
(b) You are solely responsible for verifying every input, every output, the applicability of the calculation to your specific structure and conditions, and the compliance of any resulting design with all applicable codes, standards, and jurisdictional requirements.
(c) You will independently review and confirm all results using your own professional judgment before relying on them, and you will not treat any output as a final or code-compliant result without that independent verification.
(d) Any design, document, or analysis that incorporates the Software's output is your professional work product, sealed and stamped under your responsibility, and not the Company's.
3. Scope and Limitations
(a) The Software implements specific provisions of ASCE/SEI 7-22 and supports only the building types, geometries, and conditions documented in the Software and its accompanying materials. It does not address conditions, structures, or load cases outside that documented scope, including without limitation cases the standard reserves to engineering judgment.
(b) Reference standards are periodically amended, superseded, or interpreted differently by adopting jurisdictions. The Company does not warrant that the Software reflects the version of any standard in force in your jurisdiction, or any local amendment to it. You are responsible for confirming the governing edition and any local modifications.
(c) The Software relies entirely on the accuracy and appropriateness of the data you enter. Incorrect, incomplete, or inapplicable inputs will produce incorrect outputs.
4. No Warranty
THE SOFTWARE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, THAT OUTPUTS WILL BE ACCURATE OR CODE-COMPLIANT, OR THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, BUSINESS, OR PROPERTY, OR FOR ANY PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATING TO THE SOFTWARE OR ITS OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
6. Communication of Results to Third Parties
You acknowledge that outputs may be incorporated into documents that reach owners, contractors, building officials, and other third parties. You are solely responsible for how the Software's outputs are used, communicated, and relied upon by any third party. You agree to retain the disclaimer notice that accompanies generated reports and not to remove, obscure, or alter it.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its owners, officers, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) brought by you or by any third party and arising out of or relating to your use of the Software, your outputs, your designs, or your professional services.
8. Assumption of Risk
You knowingly assume all risk arising from your use of the Software and your reliance on its outputs.
9. Governing Law
This Disclaimer is governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules.
